Actions can we take?

Blackpool Coastal Housing has dedicated Officers who deal specifically with ASB. We also work in partnership with other agencies such as Environmental Health and the Police and have a wide range of actions available to us.

Examples of these actions are:

Warning letters/Joint visits with the Police/ Office interview we will warn tenants that we have received complaints and that they need to modify their behaviour.

Installation of sound monitoring equipment- In partnership with Environmental Health, we can arrange for sound recording equipment to be installed into your home so that the noise can be monitored and used as evidence.

Mediation. –In certain cases, we may organise mediation.

Acceptable Behaviour Contracts (ABC). An Acceptable Behaviour Contract is given when a tenant or house member is behaving anti-socially at a low level. In partnership with the Police, the Housing Officer draws up a voluntary contract under which the tenant agrees to stop causing nuisance to neighbours and the local community.

We can apply to Court for an injunction or an ASBO - Injunctions are an order from the Court. We can seek an injunction to make a council tenant comply with their tenancy conditions. Breaching an injunction could result in imprisonment. Like an injunction, an ASBO is also an order from the Court. It aims to stop certain behaviour. Breaching an ASBO is a criminal offence and can result in a fine, a prison sentence or a combination of both.

Apply to the court for a demoted tenancy - This means the tenant loses their rights as a secure tenant (including the right to buy their home) for a period of 12 months. If there is any further anti-social behaviour in this period, we can apply to the court for a possession order to evict them.

Apply to the court to extend an introductory tenancy where there is a breach of tenancy, but the issue is not serious enough to evict, Blackpool Coastal Housing can apply for the probationary period to be extended.

Issue a Notice Seeking Possession of the property - This is a legal notice which could result in eviction from your home.
